Terms of Service

1. Acceptance of Terms

By accessing or using Poll Vault (the "Service"), operated by Redbud Consulting ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service. By creating an account, you represent that you meet this requirement.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to keep it up to date. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions & Billing

  • Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge the applicable fees to your payment method.
  • You may cancel your subscription at any time through your account settings or Stripe's customer portal. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Price changes will apply at your next billing cycle.
  • Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.

5. Acceptable Use

You agree not to:

  • Use automated tools, bots, or scrapers to access or extract data from the Service
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Misrepresent poll data or analysis obtained from the Service
  • Redistribute content from the Service beyond the scope of your subscription

6. Intellectual Property

The Service, including its design, features, AI-generated analysis, and original content, is owned by Redbud Consulting and protected by applicable intellectual property laws. Polling data displayed on the Service is sourced from third-party organizations, and ownership of that data remains with its respective publishers. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your own professional purposes.

7. User Content

You retain ownership of content you create on the Service (comments, notes, suggestions). By posting content, you grant us a non-exclusive, royalty-free license to display it within the Service. You are responsible for ensuring your content does not violate any third-party rights or applicable laws. We may remove content that violates these Terms.

8. White-Label Exports

Subscribers with eligible plans may use white-label export features to produce branded reports. You may distribute these exports within your organization or to your clients. You may not resell or sublicense access to the Service itself through white-label exports.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

  • Poll data and analysis are provided for informational purposes only. We make no guarantees regarding the accuracy, completeness, or timeliness of any polling data.
  • AI-generated summaries and analysis may contain errors or inaccuracies. You should verify information independently before relying on it for professional decisions.
  • Displaying polling data does not constitute endorsement of any candidate, party, position, or organization.
  • The Service is not a substitute for professional political analysis, legal advice, or strategic consulting.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REDBUD CONSULTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Redbud Consulting and its officers, employees, and agents from any claims, losses, or damages (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to account deletion.

13. Governing Law

These Terms are governed by the laws of the District of Columbia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in the District of Columbia.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
